Mediation and Negotiation Ethics
with Mel Rubin
As mediation’s usage increases and markets and users become more sophisticated, competition increases and the lines of ethics can become blurry. Mediators in newer markets need to discuss and flesh out ethical issues and embed thoughtful decision-making.
This highly interactive ethics program will deal with the ethics in one’s mediation style and the ethics inherent in the business of practicing mediation. A substantial portion of this course relates to ethics in marketing mediation, including issues in advertising, marketing, billing practices, engagement letters, settlement agreements, providing a safe and secure mediation environment, and other ethical considerations. The course will also cover the traditional ethical issues surrounding confidentiality, disclosure, conflicts of interest and bias and others.
Mediators will explore the unique aspects of dual professions and the potential conflicts for attorney-mediators and other licensed professionals practicing mediation when confronted with conflicting and competing ethical responsibilities, including confidentiality versus mandated reporting obligations.
Mr. Rubin has extensive experience in the field of ethics and mediation, having lectured and written extensively in this area and has served for over 12 years on the Florida Supreme Court Committee on ADR, often dealing with these issues and the issues for which mediators are disciplined.
Approved for 10 hours, including 3 hours of ethics and 1 hour of elimination of bias of California MCLE Credits in California.
