Mediators often approach conflict through the lens they know best. But complex disputes rarely exist in only one dimension. A resolution that makes legal sense may overlook important relationship dynamics; one that addresses emotions may miss practical business realities; and a workable compromise may leave a more creative solution undiscovered. When mediators rely too heavily on a single perspective, critical information—and better paths to resolution—can remain hidden.

In this highly interactive program, Lee Jay Berman examines a single commercial and business partnership mediation through four powerful lenses: legal and risk assessment; human behavior, relationships, and psychology; practical business realities; and creative problem-solving. Participants will see how each lens reveals different layers of the conflict and how shifting perspectives can uncover dynamics, obstacles, and opportunities they might otherwise miss.

Most importantly, the program helps mediators move beyond their default approaches and see more of what is actually happening in the room. By learning to examine the same conflict from multiple perspectives, participants can broaden the possibilities for resolution, develop more imaginative solutions, create surprising breakthroughs, and add greater value to every mediation.

About the Trainer:

Lee Jay Berman began as a full-time mediator 30 years ago, and has successfully mediated over 3,000 matters, many of which were high profile cases.  Chambers USA has ranked him as one of the top commercial mediators in the U.S. from 2018-2024, naming him to their “Band 1” since 2023 as one of the top 16 mediators in the U.S.  He has been voted by his colleagues into the Who’s Who of International Commercial Mediation from 2012-2023, and was recently named one of the 10 Global Thought Leaders in North America.  ADR Times also recently named him to their inaugural “Who’s Who in ADR”.  The National Academy of Distinguished Neutrals (NADN) named him their inaugural “Distinguished Neutral of the Year” in 2017.  California’s Daily Journal twice named him “Top Neutral”.  And, the Southern California Mediation Association has honored him with their Excellence in Civil and Employment Mediation Award (2026), their Cloke-Millen Peacemaker of the Year (2021), and Randolph Lowry Award (2010) for his work as a mediator, trainer, and thought leader in the field.
